To see if the town will vote to accept, in their current condition, as Class V Town-maintained highways, the following roads identified as Emergency Lanes by the Board of Selectmen: Sherwood Lane; Langley Lane; Little John Lane; Snow Lane; Rogier Place, beginning at its interesection with Water Street, bearing northwest at the fork and ending at Tax Map 1, Lot 124; and Water Street, beginning at its intersection with Cooper Hill Road and ending at Tax Map 1, Lot 107. The combined lenght of these roads is approximately 0.7 miles and have been maintained by the Town for several decades. Majority vote required. By citizen petition.


The decision rationale here is nearly identical to that in the 2021 Warrant Article to accept most of the Town's other Emergency Lanes as public roads, described at length in www.NottinghamRoads.org and overwhelmingly approved by the voters. The key difference is that these residents have not filed a class action suit against the Town due to the misclassification of their roads, but, as the prior class action against the Town demonstrated, the Town is at substantial legal risk. The voters can avoid this by accepting these roads to ensure that the Town is in compliance with state law.

Recommendation: Vote Yes.
